VIP Membership Plan — Terms and Conditions

1. The Program
The VIP Membership Plan (the “Plan” or “Membership”) is a dental membership program offered directly by Children’s Dental Care of Delray Beach (“the Practice,” “we,” “us”) to its patients. The Plan provides enrolled children with specified preventive dental services and discounted fees on other dental treatment performed at our office, in exchange for a recurring membership fee. These Terms and Conditions (the “Terms”) form the agreement between the Practice and the enrolling parent or legal guardian (“you,” the “Member”).
2. This Is Not Dental Insurance
THE VIP MEMBERSHIP PLAN IS NOT INSURANCE. It is not a qualified health plan, a prepaid limited health service organization plan, or a discount medical plan offered by a third party. It is a direct agreement between you and the Practice for services provided only at Children’s Dental Care of Delray Beach. The Plan does not make payments to any third-party providers, does not cover services performed outside our office, and cannot be used to satisfy any legal requirement to carry insurance. Membership fees are not premiums, benefits are not claims, and there is no coordination of benefits.
The Plan is offered by the Practice directly and exclusively to its own patients, and all membership fees are paid directly to the Practice. No third-party discount plan organization, plan administrator, or marketer is involved in the Plan. (See § 636.204(6), Florida Statutes.)
3. Eligibility and Enrollment
- Enrollment is available for pediatric patients of the Practice. Each child must be individually enrolled by name.
- By enrolling, you represent and warrant that you are the parent or legal guardian of each enrolled child, or are otherwise legally authorized to enroll the child and agree to these Terms on the child’s behalf.
- Membership benefits apply only to the specific child or children named at enrollment. Benefits are personal to each enrolled child and are not transferable to siblings, relatives, or any other person.
- The Practice may verify identity and enrollment information and may decline or cancel any enrollment that contains inaccurate information.
- Children whose Membership was previously cancelled are subject to the re-enrollment waiting period and re-enrollment fee described in Section 8 before they may be enrolled again.
- The Plan is not intended for use with services covered by Medicaid, Florida KidCare/CHIP, TRICARE, or any other state or federal health care program, and Plan benefits and discounts may not be applied to any service payable by such a program. If your child is covered by one of these programs, please contact our office at 561-279-4080 before enrolling.
4. Membership Fees and Billing
- The membership fee is $19.00 per month for each enrolled child. Where multiple children in the same family are enrolled together, fees are billed as a single combined monthly charge.
- Fees are billed automatically each month to the payment method you provide at enrollment, on or about the same calendar day as your original enrollment date. By enrolling, you authorize the Practice and its payment processor to charge your payment method on a recurring monthly basis until you cancel.
- Your Membership continues month to month with no long-term commitment. It automatically renews each month until cancelled as described in Section 8.
- Payments are processed by Stripe, a third-party payment processor. The Practice does not store your full card number. Stripe’s own terms and privacy policy apply to payment processing.
- If a monthly payment fails, we will attempt to re-process it. Membership benefits are suspended while any membership fee is past due, and the Practice may cancel the Membership if payment is not brought current within thirty (30) days.
- The Practice may change membership pricing or Plan benefits by providing at least thirty (30) days’ advance notice. Changes take effect at your next billing cycle after the notice period. If you do not agree to a change, you may cancel before it takes effect.
5. Included Benefits
During each Membership Year (defined below), and while the Membership is active and in good standing, each enrolled child receives:
- Two (2) routine prophylaxis (cleaning) procedures per Membership Year — D1110 or D1120, as applicable to the patient
- Two (2) examinations per Membership Year — comprehensive (D0150) and/or periodic (D0120), as clinically appropriate
- Routine bitewing radiographs (D0272 or D0274), as clinically indicated
- One (1) emergency/limited problem-focused examination (D0140) per Membership Year
- Priority scheduling for emergency appointments
A “Membership Year” is each successive twelve (12) month period beginning on the child’s enrollment date, provided the Membership remains continuously active.
Routine cleanings only — periodontal therapy is not included. The included prophylaxis benefit covers routine preventive cleanings only (D1110 / D1120). It does not include periodontal or therapeutic procedures, including but not limited to scaling in the presence of generalized moderate or severe gingival inflammation (D4346), scaling and root planing (D4341 / D4342), full mouth debridement (D4355), or periodontal maintenance (D4910). If the treating dentist determines that periodontal treatment is clinically indicated in place of or in addition to a routine prophylaxis, that treatment is not covered by the membership fee. It is charged at the Practice’s regular fee, less the periodontal therapy discount described in Section 6, and it does not count against or substitute for the included prophylaxis benefit.
Benefit accrual: the included prophylaxis and examination procedures become available at a rate of one (1) of each per six (6) months of continuous, paid enrollment (the first available upon enrollment; the second after six (6) months of active membership). The included emergency/limited examination is limited to one (1) per enrolled child per Membership Year. Benefits have no cash value, may not be exchanged for other services or refunds, and unused benefits do not roll over to a subsequent Membership Year.
All included procedures are provided only when clinically appropriate and remain subject to the professional judgment of the treating dentist. CDT procedure codes are referenced for clarity of scope only; the American Dental Association periodically revises CDT codes, and references in these Terms are to the corresponding procedure as then-currently coded.
6. Member Discounts
While the Membership is active and in good standing, enrolled children receive the following discounts on treatment performed at our office:
- 15% off general dentistry
- 15% off periodontal therapy, including scaling in the presence of generalized moderate or severe gingival inflammation (D4346), scaling and root planing (D4341 / D4342), full mouth debridement (D4355), and periodontal maintenance (D4910)
- 10% off orthodontics
- 10% off oral surgery
- 15% off implants
Discounts apply to the Practice’s regular office (UCR) fees in effect at the time of service. Discounts apply only to services performed at Children’s Dental Care of Delray Beach and do not apply to outside laboratories, specialists, pharmacies, or any provider other than the Practice.
No stacking: Membership discounts cannot be combined with dental insurance, promotional financing (including CareCredit promotional plans), payment plans, or any other discount, coupon, or special offer. Where more than one discount or benefit could apply, the single greatest applicable discount or benefit will be applied.
7. What the Plan Does Not Include
- Any service not expressly listed in Section 5 is not included in the membership fee. Non-included services are charged at the Practice’s regular fees, less any applicable member discount under Section 6.
- Periodontal and therapeutic cleanings are not included in the membership fee, as described in Section 5. They are discounted under Section 6.
- The Plan does not include services performed by outside providers, hospital or facility fees, sedation or anesthesia services provided by third parties, prescription medications, or treatment the treating dentist determines is not clinically appropriate.
- All treatment remains subject to the professional judgment of the treating dentist. Membership does not guarantee that any particular treatment will be recommended or performed.
8. Cancellation and Refunds
- You may cancel at any time, for any reason. Cancel online through the self-service billing portal (accessible from the “Manage subscription” link in your payment receipt emails or at https://billing.stripe.com/p/login/eVq7sLgCIasr5i1aRwawo00), or by contacting our office at 561-279-4080.
- Cancellation takes effect at the end of the current monthly billing period. You will not be charged again after cancellation, and no refunds or credits are issued for partial months or for unused benefits.
- Fair-use adjustment on early cancellation: if a Membership is cancelled and, as of cancellation, the value of included services already received in the current Membership Year (measured at the Practice’s regular UCR fees, less discounts under Section 6) exceeds the total membership fees actually paid in that Membership Year, the Practice reserves the right to invoice the Member for the difference. Alternatively, the Practice may, at its discretion, waive this adjustment.
- Re-enrollment lockout: if a Membership is cancelled for any reason (whether by you or by the Practice), the cancelled child or children are not eligible to re-enroll in the Plan until ninety (90) days after the cancellation effective date. Any re-enrollment is subject to (a) a one-time re-enrollment fee of $99.00 per child, payable at re-enrollment; (b) the pricing and terms in effect at the time of re-enrollment; and (c) a new Membership Year and benefit accrual schedule under Section 5, beginning on the re-enrollment date. Prior membership periods do not carry over. The Practice may waive the waiting period or the re-enrollment fee in its sole discretion (for example, where cancellation resulted from an expired payment card).
- The Practice may terminate a Membership for non-payment, misuse of benefits, misrepresentation at enrollment, or termination of the patient relationship consistent with applicable law and professional obligations. If the Practice terminates other than for cause, any prepaid unused fees for the current period will be refunded pro rata.
9. Changes to or Discontinuation of the Plan
The Practice may modify these Terms or discontinue the Plan upon at least thirty (30) days’ notice, delivered by email to the address on file or posted at our office and website. Modifications apply prospectively from your next billing cycle. If the Plan is discontinued, billing stops and each enrolled child retains access to any accrued, unused Section 5 benefits for sixty (60) days following discontinuation.
10. Privacy
Enrollment information (parent/guardian name, contact information, billing address, enrolled child names, and payment details) is collected for the purpose of administering the Plan. Payment card details are collected and stored by Stripe, not by the Practice. Health information created or maintained in connection with dental treatment is handled in accordance with the Practice’s Notice of Privacy Practices and applicable law, including HIPAA.
11. General Terms
- Entire agreement: these Terms, together with the enrollment information you submit at checkout, are the entire agreement between you and the Practice regarding the Plan, and supersede any prior statements or marketing materials.
- No guarantee of results: the Plan is a pricing and benefits program. It is not a guarantee of any clinical outcome.
- Severability: if any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
- Assignment: you may not assign or transfer the Membership. The Practice may assign this agreement in connection with a sale or reorganization of the Practice.
- Governing law and venue: these Terms are governed by the laws of the State of Florida. Any dispute arising out of the Plan shall be brought in the state courts located in Palm Beach County, Florida.

12. Acceptance
By checking the acceptance box and completing enrollment, you acknowledge that you have read and understood these Terms, that you agree to be bound by them on your own behalf and on behalf of each enrolled child, and that you authorize recurring monthly charges to your payment method as described in Section 4.
